Gideon Rosen (2014) has drawn our attention to cases of duress of a particularly interesting sort: the person's ‘mind is not flooded with pain or fear’, she knows exactly what she is doing, and she makes a clear-headed choice to act in, as Rosen says, ‘awful ways’. The explanation of why we excuse such actions cannot be that the action was not voluntary. In addition, although some duress cases could also be viewed as necessity cases and thus as justified, Rosen (...) wisely sets aside that complicating factor by zeroing in on those cases where the action clearly is not justified. So why do we excuse in these cases, where the action is not justified and the agent acted voluntarily?Rosen thinks the key lies in the ‘ill will’ condition, ‘the idea that an act is blameworthy only if it manifests insufficient concern or regard for those affected’. He says this is relatively uncontroversial; much of my paper is taken up with calling the ‘ill will’ condition into question. I also take issue with Rosen on just how justifications and excuses differ. I argue in favour of understanding justifications (in a context where we are asking how justifications and excuses differ) as not requiring truth, but only reasonable belief. (shrink)

During the past decade ethical theory has been in a lively state of development, and three basic approaches to ethics - Kantian ethics, consequentialism, and virtue ethics - have assumed positions of particular prominence.

This paper explores two persistent questions in the literature on presumptions: the place and the nature of presumptions in law and legal argumentation. These questions were originally raised by James Bradley Thayer, one of the masters of the Law of Evidence and the author of the classic chapter devoted this subject in A preliminary treatise on Evidence. Like Thayer, I believe that these questions deserve attention. First the paper shows that the connection between presumptions and argumentation is a constant feature (...) in the literature on presumptions, since its foundation in the Middle Ages to modern times. James Bradley Thayer was probably the last jurist who clearly saw that presumptions belong to argumentation. Second, the paper examines two sources of controversy in the language of presumptions. First, “presumption” is an ambiguous word in the legal discourse. As a result, it is almost impossible to provide a clear and succinct answer to the question “What is a presumption?”. Second, there are at least four reconstructions of the concept of presumption whose merits and shortcomings are relevant to explore. The analysis presented here may be of interest for legal and non-legal scholars and, hopefully, it may help to shed light on the possibilities and limits of an interdisciplinary dialogue about presumptions. Marcia Cavell draws on philosophy, psychoanalysis, and the sciences of the mind in a fascinating and original investigation of human subjectivity. A "subject" is a creature, we may say, who recognizes herself as an "I," taking in the world from a subjective perspective; an agent, doing things for reasons, sometimes self-reflective, and able to assume responsibility for herself and some of her actions. If this is an ideal, how does a person become a subject, and what might stand in (...) the way? One of Marcia Cavell's guiding premises is that philosophical investigation into the specifically human way of being in the world cannot separate itself from investigations of a more empirical sort. Cavell brings together for the first time reflections in philosophy, findings in neuroscience, studies in infant development, psychoanalytic theory, and clinical vignettes from her own psychoanalytic practice. Omnipresent in popular culture, especially in film and literature, the theme of the 'end of the world' is often rejected from contemporary philosophy as hysterical apocalyptism. This volume attempts to show that it is vital that we address the motif of the 'end' in contemporary world – but that this cannot be done without thinking it anew.

O problema abordado é o das relações entre o tecnológico e o sagrado no contexto dos discursos filosóficos, historiográficos e sociológicos sobre a técnica e a tecnologia. A ciência e tecnologia normalmente são pensadas e caracterizadas em oposição às crenças religiosas, aos mitos e à mística. Nesse sentido, são consideradas como ápice da racionalidade, do método e da eficiência em oposição à fé. Entretanto, como veremos neste artigo, esse modo de pensar a tecnologia e a ciência é apenas um dos (...) modos possíveis de se pensar a relação entre elas e o sagrado e o religioso. Por isso, neste artigo sistematizam-se, analisam-se e comparam-se três vertentes contemporâneas. A primeira, referente à posição dos autores Jacques Ellul e Martin Heidegger, sustenta que a tecnologia supera e destrói o sagrado, e agora ocupa o seu lugar. A segunda, proposta pelos autores David Noble e Erik Davis, descreve a tecnologia como sendo ela mesma sagrada, na perspectiva de as tecnologias contemporâneas possibilitarem ao ser humano alcançar os próprios ideais de transcendência e de superação da finitude. A terceira, embora reconheça a associação entre a tecnologia e as categorias do sagrado, elabora uma crítica ao discurso de caráter salvífico sobre a tecnologia. (shrink)

What is the relation between shame and shamelessness? It may seem obvious: shamelessness is simply the absence of shame. But on reflection, it becomes clear that the story is considerably more complicated. Michelle Mason's intriguing "On Shamelessness" prompts such reflection. Mason argues that we should be mindful of the "moral importance of shame" and "unapologetic in its defense", and she does so via an examination of shamelessness and an argument to the effect that shamelessness is a moral fault. The tacit (...) assumption is that insofar as shamelessness is a moral fault, the value of shame is vindicated. I challenge that assumption. (shrink)

The emphasis on duly in Kant's ethics is widely held to constitute a defect. Marcia W. Baron develops and assesses the criticism, which she sees as comprising two objections: that duty plays too large a role, leaving no room for the supererogatory, and that Kant places too much value on acting from duty. Clearly written and cogently argued, Kantian Ethics Almost without Apology takes on the most philosophically intriguing objections to Kant's ethics and subjects them to a rigorous yet (...) sympathetic assessment. It is widely agreed that the top three Model Penal Code culpability levels suffice for criminal liability, but the fourth is controversial. And it isn’t just the particular MPC wording; that negligence should be on the list at all is controversial. My question is: What makes negligence so different? What is it about negligence that gives rise to the view that it should not suffice for criminal liability? In addressing it, I draw attention to how we conduct the debate, and (...) how our framing of the issues is shaping it. My hope is to prompt thought and discussion on just what we want the element of mens rea to provide, and to draw attention to background assumptions that shape our views of what it should take for negligence to count as a species of mens rea. Se na filosofia e história do corpo os posicionamentos são agrupados entre os que consideram haver substância única (Espinosa) ou dupla (Descartes) que conformam diferentes aspectos dos indivíduos (alma/mente – corpo), na filosofia da ciência nos confrontamos com a o terceiro excluído nestes dualismos com consequências existenciais: trata-se da técnica ou, para utilizarmos um termo mais preciso, das tecnologias. Neste sentido, a máquina é um corpo, não do tipo que nasce naturalmente: as máquinas nascem de um parto artificial, emergem a (...) partir do trabalho de múltiplas mãos, como na construção de uma casa ou na plantação de tomates; embora, depois da mecanização do campo com as promessas de abundância da produção sem limites própria da Revolução verde, esteja cada vez mais difícil identificar com quantas mãos se faz uma plantação... Este trabalho analisa a influência tributária na definição do modelo constitucional de atribuição dos resultados econômicos da exploração do petróleo offshore, no Brasil. Além da abordagem constitucional do tema, destaca-se a participação dos entes federativos estaduais nas rendas da produção de petróleo, sua federalização e, em decorrência, a redução das rendas dos entes federativos subnacionais, implicando num movimento compensatório pela via da utilização de elementos de natureza tributária, tais como o extinto Imposto Único sobre Minerais e o regime constitucional especial (...) de cobrança na origem do ICMS devido nas operações de combustíveis e derivados de petróleo. Nossa comunicação terá um objetivo duplo. De uma parte, esclarecer alguns conceitos que fundamentam o conhecimento químico na segunda metade do séc. 18 e, de outra, explicitar seu uso como instrumento no laboratório filosófico de Jean-Jacques.

O objetivo deste artigo é investigar a concepção enciclopédica de revolução científica posta em prática pelo químico francês L.-B. Guyton de Morveau (1737-1816). Deslocando a análise do conhecimento químico das Luzes do programa traçado por Lavoisier (1743-1794), sugerimos uma concepção revolucionária republicana, proclamada como resultado do esforço de uma coletividade. Daremos destaque a três abordagens revolucionárias de Guyton de Morveau no âmbito da química. A primeira foi sua atuação no ensino dessa ciência, cuja pedagogia e métodos de ensino foram fundamentais (...) para sua imersão social. Além disso, entre 1770 e 1790, Guyton de Morveau teve desempenhos decisivos no seio da empresa enciclopédica e no seio da escola química francesa. (shrink)

Quando se aborda a chamada Revolução científica moderna normalmente se faz referência à astronomia e à física-matemática. O conhecimento químico não é considerado como paradigma para a emergência da ciência moderna. Neste brevíssimo artigo apenas apontarei alguns elementos e eixos de investigações dedicados ao estudo da natureza química e das propriedades dos materiais, essenciais para o novo modelo de sociedade que emergiu na modernidade. Assim, vamos a uma rápida visita a alguns lugares-epistêmicos do século XVII nos quais poderíamos nos deparar (...) com a química, a fim de chegarmos a algumas conclusões, mesmo que provisórias, acerca do lugar deste conhecimento na emergência de uma nova cultura científica. RESUMO Neste artigo pretendo identificar um "estilo de raciocínio" próprio à química e apontar a disseminação de seus produtos e conceitos. O objetivo é o de explicitar alguns elementos que caracterizam o estilo de pensar e de fazer da química na segunda metade do século XVIII, sua capilarização técnico-cultural. O delineamento de um estilo químico de raciocinar origina-se da constância dos espaços técnico-epistêmicos em que o saber químico é construído. A química é uma ciência de laboratório, eminentemente técnica e operatória, (...) quer dizer, trata-se de um conhecimento técnico-científico stricto sensu. Produtora de artefatos, a ciência química é inseparável da técnica, da tecnologia e da indústria, de maneira que sua identidade epistêmica é indissociável de sua história. Seu estilo caracteriza um valor profundo na cultura técnica do homo faber, do poder de agir sobre a natureza e de transformá-la através de manipulações e de rearranjos. ABSTRACT In this paper I will identify a "style of reasoning" that is proper to to Chemistry and to point to the dissemination of its products and concepts. My aim is to explain some elements that characterize the style of thinking and engaging in Chemistry in the second half of the 18th century, its techno-cultural capillary action. The shaping of a chemical style of reasoning originated from the constancy of the techno-epistemic sites in which chemical knowledge is formed. Chemistry is a laboratory science, eminently technical and operative, i.e., it deals with a techno-scientific knowledge stricto sensu. A producer of artifacts, chemical science is inseparable from technique, technology and industry, in such a way that its epistemic identity is inseparable from its history. Its style marks a profound value in the technical culture of the homo faber, the power of acting upon nature and transforming it through manipulations and rearrangements. (shrink)

When is a proposition true? It is common to expert an answer of the form “at instant x”. In section I) I present an example of the consequences that such instantaneous semantics in tense logic can have, and review some of the problems that have led to the proposal of using intervals, rather than instants, as the indices at which to evaluate propositions. In the section II) I present some of the problems with the intervals themselves, and in section III) (...) I consider the possibilities of having he best of both worlds. Due to the still tentative character of interval semantics, I focus on the consideration of metatheoretical issues rather than on the technical points of the particular systems of interval semantics so far proposed. A proposta de organização deste número especial do Cadernos PET Filosofia surgiu da demanda de estudantes do Curso de Filosofia da Universidade Federal do Paraná (UFPR) para que fosse ofertada uma disciplina optativa tratando da emergência da noção de Tecnociência no cenário filosófico contemporâneo. Essa demanda foi parcialmente contemplada, com a inclusão do tema nos planos de ensino das disciplinas ofertadas durante o ano de 2021 pelos professores Ronei Clécio Mocellin e Débora Aymoré, iniciativa esta posteriormente replicada no contexto (...) das atividades acadêmicas realizadas nos ambientes virtuais de aprendizagem da Universidade do Estado do Amapá (UEAP). Uma investigação sobre o risível, a manipulação da imagem e o esteticamente correto. DA autora de Como conversar com o fascista. As cenas ridículas – e os personagens já muito conhecidos – traduzem o sentido da política em nossos dias, mas não apenas como uma bagunça feita por pessoas despreparadas para os cargos que ocupam. A Deturpação serve a uma nova política, em um sentido altamente problemático: o poder é transformado em violência, e a seriedade de certos assuntos dá lugar (...) ao cinismo. ABusadores do poder seguem sempre mais poderosos como engraçadinhos ou bufões inofensivos, muitas vezes até confiáveis, enquanto a população paga preço altíssimo por uma despolitização apresentada como o melhor dos mundos. SOltos em escala social, o fascismo, o machismo e o racismo dão o ritmo e o tom da política em nossos dias sem que pareça que algo possa ser feito. Ao introduzir a noção de “ridículo político” no debate sobre estética e política, os ensaios deste livro são uma contribuição original – e fundamental – de Marcia Tiburi para que pensemos sobre quão grave é o hábito de não tratar com seriedade as coisas políticas.
